Welcome to AquaLease, your provider for luxury ship and boat charters in India. These Terms & Conditions govern your charters, website usage, and interactions with our brand. By using our website and chartering our vessels, you agree to these Terms.

Eligibility

You must be 18 years or older, or represent a legitimate business entity, to charter a vessel from this website. You confirm that you and your party will adhere to all safety instructions provided by the captain and crew. The primary charterer assumes all responsibility for the conduct of their guests.

Account and Charter Requirements

You agree to provide current, complete, and accurate charter and account information for all bookings placed through our service. This includes passenger lists and identification where required for port authorities. We reserve the right to refuse any charter you place with us or to limit or cancel bookings per person, per company, or per order.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device to prevent unauthorized bookings.

Vessel Availability and Information

We make every effort to display as accurately as possible the images and specifications of our yachts, boats, and other vessels. In the rare event of unforeseen mechanical issues or unavailability, we reserve the right to substitute a vessel with a model of equivalent or superior specifications. We reserve the right to limit the charter of our vessels to any person, geographic region, or jurisdiction.

Fees & Pricing

All prices are listed in Indian Rupees (INR) and are exclusive of applicable taxes (like GST) unless stated otherwise. Charter fees typically include the vessel and crew; fuel, provisions, and port fees are often covered by an Advance Provisioning Allowance (APA) as detailed in your charter agreement. We accept various secure payment methods as indicated during the booking process. Prices for our charters are subject to change without notice.

Charter Changes & Cancellations

If you wish to modify or cancel your charter, please contact our client relations team immediately. Changes and cancellations are subject to the timeframes and fees outlined in our Cancellation & Refund Policy below and in your specific charter agreement.

Cancellation & Refund Policy

A full refund of the charter fee (less any non-refundable processing charges) is available for cancellations made more than 60 days before the charter start date. Cancellations made between 30 and 60 days prior are eligible for a 50% refund. Cancellations within 30 days of the charter start date are non-refundable, as the vessel, crew, and provisions have been reserved and committed. No refunds are provided for no-shows or failure to embark.

Intellectual Property & Website Use

The AquaLease name, logo, and all related service names, designs, and slogans are the intellectual property of AquaLease. All content on this website, including text, graphics, logos, and images, is our property and protected by copyright laws. Unauthorized use, reproduction, or distribution is strictly prohibited.

Vessel Use & Liability

Clients are responsible for any damage to the vessel or its equipment caused by their party, beyond normal wear and tear. AquaLease is not liable for the loss or damage of personal belongings, itinerary changes due to weather or factors beyond our control, or personal injury resulting from a guest's failure to follow crew instructions. Our total liability for any charter is strictly limited to the charter fee paid for that specific booking.

Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

Policy Updates

We reserve the right to update or modify these Terms & Conditions at any time. Revised Terms will be posted on our website. Your continued use of the website and our charter services following any changes constitutes your acceptance of the new Terms.
